What's up with the Contested case?

The contested case against the B2H has been crazy!  We are in our 20th month and 19 of us, “contested case warriors,” are still working exceptionally hard with minimal legal support.  Interested in what some of the contested issues are?  We are sharing six case summaries for your curiosity and enjoyment.  They are brief but will give you the idea about what we are fighting; next month we’ll send you more…
 
Closing Arguments/briefs were submitted in our Contested Case at the end of February. At the end of March, we needed to file “Response briefs.”  Then, the very next day, Idaho Power challenged nearly all of us with “motions to strike” portions of our Closing briefs and Response briefs, with response due in seven days.  Without getting into the legal sagas and snafus, suffice to say:  Idaho Power is trying to break us:  emotionally and financially.  We cannot let them do this!

Fuji Kreider & 4 other Stop B2H volunteers:  Noise Control & State Variance. Idaho Power admits: if they have to comply with the state noise control rules, the project is Unpermittable!  The state has proposed a blanket variance to the rules for 300 miles.
 
Irene Gilbert:  Valuation of Forest/Timber Land. If we lose, and Idaho Power takes your land, will you receive a fair amount?  Soil types are a determinant.
 
Lois Barry:  Visual Impact Assessment for Scenic & Recreation Areas. Idaho Power claims to have a robust methodology of scenic impact analysis and concluded: the transmission towers of the B2H will have "no significant impact" on the scenic values of Morgan Lake, the Oregon Trail or any other location along the 300 mile route.
 
Ginny & Dale Mammen:   Traffic Safety in landslide areas & neighborhood. Imagine a new access road being punched up the steep and unstable hillside near Grande Ronde Hospital? Imagine a quiet neighborhood being used as a huge industrial construction site for 50 ton cranes and rigs?
 
Matt Cooper:  Wildfire Risk & Emergency Response.  Do we have assurance that the risk of wildfire caused by transmission has been evaluated? Are our fire departments prepared?  Given the recent wildfires and utilities, what do you think?
 
Kevin & Anne March:  Snake River Basin Steelhead - Fish Passage & Ladd Creek. The inquisitive fish have found their way back up to spawning grounds in Ladd Creek which has been blocked for decades.  Now, where is the plan for B2H crossing?
