Dear CIIR friend,

We are delighted to present the new format for the CIIR newsletter, which will update you 3-4 times a year on our work at the Centre for Information and Innovation Law.

With the newsletter we want to give you a condensed overview of current developments, events, our teaching and research. We hope you find this helpful and are looking forward to your feedback.

The last three months have been busy at the Centre for Information and Innovation Law. In March, we welcomed you to our CIIR Update event, where Jonathan Griffith from Queen Mary University presented his thoughts on copyright and parody. In addition, our very own Ana Nordberg, Morten Rosenmeier and Henrik Udsen gave you an update on stem cell patents, (digital) exhaustion and IT law news.

Knud Wallberg and Helen Yu have handed in their PhD dissertations. An invitation for their respective PhD defences will be sent out in a separate e-mail. We are happy to announce that both have been employed as research assistants by the Centre.

Finally, we also want to draw your attention to the centre's twitter account @CIIR_KU, where we encourage you to follow us for the most recent updates.

Bolar Exemption and Third Party Suppliers. Comparison of legal approaches and case law in the United Kingdom, Germany, Denmark and Poland

Specialet undersøger omfanget og implementeringen af Bolar undtagelsen i Storbritannien, Tyskland, Danmark og Polen. I den forbindelse analyseres det specifikke spørgsmål om tredjeparts levering af patentbeskyttede aktive farmaceutiske ingredienser til generiske producenter, og det bliver vurderet hvornår og under hvilke omstændigheder sådanne aktiviteter kan være omfattet og hermed undtaget under Bolar undtagelsen.

Retten til at blive glemt

På baggrund af Google Spain-dommen (C-131/12) indeholder afhandlingen en retsdogmatisk analyse af retten til at blive glemt efter persondatadirektivet. Analysen munder ud i en stillingtagen til Google Spain-dommen hvor det særligt vurderes, om EU-domstolens ”test” for, hvornår internetsøgemaskinerne skal slette links til hjemmesider med personoplysninger, er udtryk for en overbeskyttelse af privatlivet på bekostning af informationsfriheden.

Den immaterialretlige beskyttelse af butiksindretninger

En måde hvorpå virksomheder kan opbygge et stærkt brand og image omkring deres virksomhed, er ved at udvikle en særegen butiksindretning. Problemstillingen rent juridisk er, hvorvidt en butiksindretning kan opnå immaterialretlig beskyttelse, således at virksomhederne blive beskyttet mod at konkurrenter efterligner deres indretning og lukrerer på deres goodwill. Dette spørgsmål er ikke ganske afklaret, og specialet søger derfor at fastlægge gældende ret på området.

CIIR profile: Ana Nordberg

Ana Nordberg is a former practicing lawyer and a CIIR member since 2010. In March 2014 Ana defended her Ph.D. Thesis - Patenting Nanomedicine in Europe: Applying the ‘medical exception’ to emerging technologies - and is now a Post-doctoral researcher.

Ana has a strong interest in science and technology in the Biotechnology, Pharmaceutical and Health sector and is fascinated with legal issues surrounding new and emerging technologies. Generally, Ana’s research focuses around Intellectual property Law with particular emphasis in Patent law, but involves a broader spectrum of legal topics, subjects and perspectives, such as other forms of Intellectual property, open innovation, competition law, EU and International Law, Health law, Comparative law and regulatory issues.

Her current research project concerns Synthetic biology and has the objective to map potential legal challenges of synthetic biology and debate selected legal issues that show greater practical relevance for the European and Danish synthetic biology community and society. This project is financed and conducted within the framework of an interfaculty research project – BioSYNergy.

Ana sees the Law as a dynamic reality and believes legal scholars, to a certain extent, should actively engage in research concerning the legal implications of social issues and phenomenon and thus contribute to the broader societal debate. She is also an adept of interdisciplinarity, seeking to incorporate in legal research contributes from other disciplines and to take into consideration ethical, social and economic aspects of emerging technologies and its, potential or actual, impact in law and regulation.
