On the 19th of April 2016, the Department of Human Settlements ("DHS"), supported by the Community Schemes Ombud Service ("CSOS"), briefed the National Assembly Portfolio Committee for Human Settlements, on the Regulations tabled in terms of the Sectional Titles Schemes Management Act and the Community Schemes Ombud Service Act. 

Advocate Seeng Ntsaba-Letele confirmed to the Portfolio Committee the background to the Regulations, mentioning that in 2015 they had been published for public comment and that public information sessions had been held with 746 stakeholders in attendance nationally.  She also mentioned that the Department had received 1,648 written comments from the general public and stakeholders. 

The 23 Regulations to the Community Schemes Ombud Service Act were tabled, including the Regulations relating to the CSOS levy formula and the funding model, as well as the 8 Regulations under the Sectional Titles Schemes Management Act. The Portfolio Committee chairperson said that the progress towards transformation of the housing sector should be applauded. The next step in the process of bringing the two Acts into operation, is consultation with the National Council of Provinces, and it is expected that this will take place this week.  We will keep you updated of progress in this regard.

Carryn goes on further to explain how it can affect the investment, which may result in a reduction in the market value of units. In addition it could also affect the owner’s potential rental income.
