Executive Order temporarily suspends some post-judgment collections

In light of the continuing COVID-19 pandemic, Illinois Gov. J.B. Pritzker has suspended most post-judgment collection efforts against consumer debtors. 

On April 14, 2020, Gov. Pritzker issued Executive Order 2020-25 (Order), which temporarily suspends sections of the Illinois Code of Civil Procedure that permit the service of a garnishment summons, wage deduction summons or citation to discover assets. The suspension, which the governor enacted pursuant to the Illinois Emergency Management Agency Act, is limited to consumer debtors and consumer garnishees and shall last for the duration of the gubernatorial disaster proclamation. Further, the Order does not apply to domestic support obligations, including child support and spousal maintenance obligations, and it should not be construed as relieving a debtor of any liability. The gubernatorial disaster proclamation is currently in effect through April 30, 2020, but can be extended by further order from the governor.
