Home Care Industry Leaders to Receive Special Awards at HCAOA Annual Leadership Conference

Two home care industry leaders will receive special awards at HCAOA's Annual Business Meeting on Monday, September 24. The awards that will be given are the Allen Hager Legislative Award and the Sheila McMackin Leadership Award. The purpose of the Allen Hager Legislative Award is to recognize an individual who has made a significant impact on policy or legislation related to the home care industry within the Home Care Association of America. The purpose of the Sheila McMackin Leadership Award is to honor and recognize an HCAOA Member who demonstrates exceptional leadership qualities within the association on behalf of the home care industry.
Krystal Wilkinson, Adultcare Assistance Homecare

Krystal Wilkinson will receive the Allen Hager Legislative Advocacy Award in recognition of her distinguished service in legislative advocacy for the home care industry and the HCAOA Arizona Chapter.

Krystal Wilkinson is the President and Owner of Adultcare Assistance Homecare with locations in both Phoenix and Tucson, Arizona. Her passion for home care began when her husband, a cancer survivor, needed care that stretched her capabilities. She discovered that some home care companies focused on cutting costs at the expense of family safety. Protecting clients has been her pursuit through enhancing quality of life, educating the community and advocating for employer based agencies. The past three years, Krystal has been Chair of HCAOA Arizona allowing her to collaborate with an active leadership team of home care executives dedicated to elevating standards to protect the clients we serve. As a result, the most distinguished hospitals in Arizona have started directing discharge planners to exclusively recommend members of the HCAOA.

Gale Bohling, ResCare HomeCare

Gale Bohling will receive the Sheila McMackin Leadership Award, being presented for his exceptional leadership on behalf of the home care industry and the HCAOA.
As Director of Government Relations for ResCare, now known as BrightSpring Health Services, Gale has the opportunity to work closely with the private and public sector on issues impacting Home Care Services. This, coupled with a diverse professional career covering over 40 years, gives Gale a unique perspective. With a Master’s in Public Administration, Gale’s perspective is built from experiences ranging from a small home care business owner; LTC Program Administrator for the Arizona Developmental Disabilities 1115 Waiver; and multiple leadership roles on state and national association boards.
The contributions through leadership, legislative efforts and caregiving that these individuals have offered the home care community is significant and transformational. Their hard work and efforts have had a major impact on the home care industry and our organization. We are thrilled to honor their commitment and contributions to strengthening the care we all work to provide to our clients and their families.

Roscoe Mutz is an attorney in the litigation practice group at Farhang & Medcoff, where he focuses primarily on employment law, including both disputes and handbook/policy drafting, legal compliance issues involving HIPAA, wage and hour issues, and the Arizona Medical Marijuana Act, and commercial litigation. Roscoe also co-produces a live monthly community storytelling event called “Odyssey Storytelling,” serves on the Tucson Ambassador Board and as a Wish Granter for Make-A-Wish Arizona, and serves on the board of Jr. El Tour, Inc., a non-profit that encourages youth to embrace biking as a hobby.

AB 2455 Headed to Governors’ Desk, Contact Gov. Brown Today to Request Veto!
Despite the best efforts of HCAOA members, caregivers who responded at the grassroots level and our lobbying team, we could not prevail upon the California State Senate to defeat AB 2455, the bill by Assembly Member Ash Kalra (D-San Jose).  It was approved on a 23-14 vote.  AB 2455 awaits further action by the California State Assembly but it is unlikely that the Assembly will defeat the bill.
This means the bill will advance to Gov. Jerry Brown's desk for final consideration, which will occur no later than September 30. Gov. Brown vetoed a similar bill, AB 1513 (Kalra), last year on the final day for him to consider it. The only difference between last year's bill is the information allowed to be gathered (name and cell phone) from Home Care Aides who do NOT "opt out" of such information being shared and will apply to newly-registered Home Care Aides and current Home Care Aides when they renew their registration.
HCAOA is continuing to fight for the privacy of our caregivers by opposing AB 2455. We can't accomplish this without your help and action. Contact the Governors’ office by calling (916) 445-2841 and ask the Governor to veto the bill. Below are some talking points you can use when voicing your opposition.
Talking Points:
  • AB 2455 is blatantly inconsistent with Article 1, Section 1 of the California Constitution, which states clearly Californians' rights to " and liberty, acquiring, possessing, and           protecting property, and pursuing and obtaining safety, happiness and privacy.
  • There is absolutely no state interest that justifies the disclosure of one's personal information and requires an individual to take an action - to "opt out" - in order to stay protected.
  • The Department of Finance has noted its opposition to the bill, estimating a $600K cost the for the first year to implement this policy, with subsequent years of $300K ongoing.
  • A California domestic violence organization, Women Escaping a Violent Environment (WEAVE). Opposes the bill, stating: "Requiring the disclosure of any private worker's...telephone number maintained in confidence by the State of California for compliance purposes is a breathtaking invasion of his or her constitutional right to privacy."

National Council on Compensation Insurance Recommends Decrease in FL Workers Compensation Insurance
The National Council on Compensation Insurance (NCCI) sent a letter to the Office of Insurance Regulation on Monday, August 27 with several recommendations. One of those recommendations was a proposed 13.4% rate decrease to take effect on January 1, 2019. Consistent improvement in loss experience is the primary driver underlying the recommendation. More specifically, the long-term decline in claim frequency has continued to more than offset moderate increases in claim severity. This has resulted in continued downward pressure on the overall average rate level need and is consistent with trends across most NCCI states. For more information click HERE.

Congressional Update

Labor Department to Assist Employers with Compliance

On August 28, 2018, the U.S. Labor Department announced that it is creating an office to better help companies comply with regulations before finding they have run afoul of labor laws, which policy watchers called a change in tone from an Obama-era emphasis on enforcement.
The responsibilities of the Office of Compliance Initiatives will include working with enforcement agencies to improve their effectiveness and use of data, as well as increasing outreach to both employers and employees to prevent violations. One of the first initiatives is a website to help companies understand their responsibilities and a revamped site for workers on their rights. To see the DOL’s announcement, click here
Listening Sessions on White Collar Overtime Regulations
The U.S. Department of Labor’s Wage and Hour Division has announced that in the upcoming weeks, it will hold public listening sessions to gather views on the Part 541 white collar exemption regulations, often referred to as the “Overtime Rule.”
Issued under the Fair Labor Standards Act, these regulations implement exemptions from the overtime pay requirements for executive, administrative, professional, and certain other employees. The Department plans to update the Overtime Rule, and is interested in hearing the views and ideas of participants on possible revisions to the regulations.

Senator John McCain to Lie in State

The Senate this week pays tribute to Sen. John McCain, whose body will lie in state in the U.S. Capitol Rotunda. McCain (R-Ariz.) died at 81 on August 25th — nine years to the day after Sen. Edward M. Kennedy (D-Mass.) succumbed to the same deadly brain cancer.
McCain’s body will lie in state in the Capitol Rotunda on Friday, with a formal ceremony planned for approximately 11 a.m. A service is to be held on Saturday at the Washington National Cathedral, followed by a private burial on Sunday at the U.S. Naval Academy Cemetery in Annapolis, Md.
