May is Older Americans Month

Across the country, older Americans – a rapidly growing population – are taking part in activities that promote wellness and social connection. They are sharing their wisdom and experience with future generations, and they are giving back to enrich their communities. They’re working and volunteering, mentoring and learning, leading and engaging.
 
For 55 years, Older Americans Month (OAM) has been observed to recognize older Americans and their contributions to our communities. Led by the Administration for Community Living’s Administration on Aging, every May offers the opportunity to hear from, support, and celebrate our nation’s elders.
 
It is becoming more apparent that remaining socially engaged can improve the quality of life for older adults. This year’s OAM theme, “Engage at Every Age,” emphasizes the importance of being active and involved, no matter where or when you are in life. You are never too old (or too young) to participate in activities that can enrich your physical, mental, and emotion well-being.

AB 2455 Grassroots Message
 
On May 21, the HCAOA California lobbying team held a special briefing to discuss the latest on AB 2455, a bill that would require the Department of Social Services to give upon request by labor unions the personal information of ALL home care aides registered in California.
 
Following this briefing, a grassroots message was sent to home care providers, urging them to contact their legislators. Since Monday, a total of 60 opposition emails have been sent to various members of the California State Assembly.

AB 2455 will be voted on by the Assembly Appropriations Committee this Friday, May 25 before going to the Assembly Floor for consideration.
 
We are targeting the following members of the Assembly (see below) and urge any home care provider in these districts to express your concerns with this bill.

Please visit our grassroots website and follow the instructions to call and write your legislator's office in Sacramento. Available on this site are pre-written messages and suggested talking points. While these communications may be utilized as is, all written messages can be edited and use of the talking points is optional.
 
Consider sharing this with your home care aides. Obviously, you cannot direct them to participate in this effort, but they may wish to, in which case you may provide this link and please make sure they know they'll need to click the "Switch Message" button to select the message that has been created specifically for home care aides (the message beginning with "As a home care aide in your district").
 
Please continue to reach out to local nonprofit organizations that serve victims of domestic violence and bring this to their attention, urging them to oppose AB 2455. In addition to the WEAVE opposition letter, an additional opposition letter from the Crime Survivors Resource Center was submitted on May 21. Feel free to share these letters with your legislators.

Congressional Update

Supreme Court Rules on Key Case Relating to Arbitration – Upholds Lawfulness of Class Action Waivers

 
On May 21, the U.S. Supreme Court ruled that employers can enforce waivers in arbitration programs in lieu of class-action lawsuits to press legal claims. The justices, voting 5-4 along ideological lines, said for the first time that a 1925 federal law lets employers enforce arbitration agreements signed by workers. The majority rejected contentions that a separate law guarantees workers the right to join forces in pressing claims. This is a tremendous win for HCAOA members who have put in place or plan to put in place arbitration agreements to avoid class action lawsuits. The ruling holds that these agreements can continue to be utilized legally and that practice has been protected as a result. The ruling builds on previous Supreme Court decisions that let companies channel disputes with consumers and other businesses into arbitration. The latest decision applies directly to wage-and-hour claims. Arbitration supporters say that this practice  is less expensive  and more efficient than traditional litigation.

HELP Committee Hearing Focuses on Training and Recruitment of Direct Care Workers

 
On May 22, the Senate Health, Education, Labor & Pensions (HELP) Committee held a hearing to address health workforce needs in the U.S. One focus of the hearing was geriatric training and Senator Maggie Hassan (D-NH) specifically mentioned the need to train more direct care workers to address the needs of seniors. Existing geriatric training grants administered by the Health Resources and Services Administration of the U.S. Department of Health and Human Services do provide for the provision of training for home care workers, however the focus is primarily on training physicians and nurses.

HCAOA Submits Comments to Medicaid Proposed Rule

 
On May 22, HCAOA submitted comments expressing serious concern about a proposed rule issued by the Trump Administration that would likely diminish and restrict access to vital home care services. Unless modified, this rule could significantly reduce reimbursements to providers of services.

Specifically, Centers for Medicare and Medicaid Services (CMS) is now proposing to exempt from access to care assessments in any state which Medicaid managed care plans are providing 85 percent or more of the total Medicaid services delivered. If this rule is finalized as proposed, states meeting this threshold would no longer need to document whether their Medicaid FFS payments are sufficient to assure access to Medicaid-covered care and services. The proposed rule would also exempt rate reductions less than 6 percent over two years.
 
HCAOA joins with other organizations in recommending that CMS withdraw this proposal until such time as sufficient modifications and analysis of its potential impact can be undertaken.

Rep. Kevin McCarthy (R-CA): Majority Leader in the U.S. House of Representatives

House Majority Leader Kevin McCarthy, who has such a close relationship with Donald Trump that the president has referred to him as “my Kevin,” has emerged as a key emissary between Congress and the administration.
 
McCarthy’s role as Trump’s go-to guy represents a big rebound from October 2015, when the majority leader surprised colleagues by pulling out of the race to succeed retiring Speaker John Boehner.
Like Boehner, he had run into opposition from the Republican conference’s most conservative members. His departure led Republicans to elect a reluctant Paul Ryan of Wisconsin as Speaker. Ryan, who has had an up-and-down relationship with Trump, now uses McCarthy as his top diplomat with the Trump White House.
 
After serving in the California State Assembly as Republican floor leader, McCarthy was elected to the House in 2006. In only his second term, McCarthy was appointed chief deputy whip, the top assistant to then-Minority Whip Eric Cantor. Republicans won control of the House in the 2010 elections, thanks in part to McCarthy’s efforts in recruiting candidates as a member of the National Republican Congressional Committee brain trust for that election cycle.
 
During the 2010 campaign season, McCarthy traveled the country on weekends and during congressional breaks to identify potential candidates, helping them raise money and advising on strategy. When the Tea Party movement helped Republicans win a House majority in 2010, McCarthy used his ties to the new members he had helped and the Republican leadership under Boehner to try to keep the Republican conference’s factions from breaking apart.
 
The son of a Bakersfield city firefighter, McCarthy worked his way through college buying cars at auctions and reselling them. He recalls how he used $5,000 he won in the California lottery to open a sandwich shop, called Kevin O’s Deli, when he was 19. McCarthy says he first felt the effects of government regulation when city inspectors reported that a window sign he posted violated the municipal code.
 
He was active in Republican Party politics, including a term as head of the California Young Republicans, and later was chairman of the National Young Republicans.
 
McCarthy worked for his predecessor in Congress, Republican Bill Thomas, starting as an intern and rising to the post of district director.
 
His first elective office was as a member of the Kern Community College District board of trustees in 2000. Two years later, he won election to the state Assembly; while still in his first term, he was chosen by his colleagues as Republican leader.
 
After four years in Sacramento, McCarthy ran for the House when Thomas decided to retire. He swamped two other candidates in the Republican primary and went on to win the November general election with 71 percent of the vote. Democrats declined to field a candidate in 2008, 2010 and 2012.
 
He was re-elected with 69 percent of the vote in 2016.
