Urge Your Caregivers to Defend Their Privacy!

In our efforts to appeal to members of the California Senate as they consider a vote on AB 2455, we are urging all home care providers in California to ask their caregivers to visit the Protect Caregiver Privacy website ( Please encourage caregivers to support the letter on this site, which asks members of the California Senate to protect a caregiver's constitutional right to privacy and to vote "NO" on AB 2455 when it comes for a vote on the Senate floor. A list of all caregivers supporting the letter will be sent to members of the California Senate.

HCAOA Submits Comments in Support of Medicaid Proposed Rule

On August 13, HCAOA submitted comments to the Centers for Medicare and Medicaid Services (CMS) regarding its proposed rule on titled “Medicaid Program Reassignment of Medicaid Provider Claims,” which was issued July 12, 2018.
HCAOA submitted its comments in support of the CMS proposal to end the ongoing practice in some states of assignment of Medicaid funds owed to personal care providers to third parties. HCAOA sees this as a matter of fairness and transparency. This practice takes place in several states including California, Connecticut, Illinois, Maryland, Massachusetts, Minnesota, Missouri, Oregon, Vermont, and Washington. In 2015, Pennsylvania’s Governor attempted to do the same by executive order, but that order is currently enjoined by a state court.
To receive federal funding, states that operate Medicaid programs must comply with certain federal requirements. Section 1902(a)(32) of the Social Security Act (the Act) requires direct payment to providers who render services to Medicaid beneficiaries. It states that no payment under the plan for care and services provided to an individual shall be made to anyone other than such individual or the person or institution providing such care or service, under an assignment or power of attorney or otherwise.
As CMS notes in the explanation of this proposed rule, the regulations implementing section 1902(a)(32) of the Act have generally tracked the plain statutory language and required direct payments absent a statutory exception. However, in 2012 CMS proposed a new regulatory exception in the ‘‘Provider Payment Reassignment, and Setting Requirements for Community First Choice’’ published on May 3, 2012 (77 FR 26361, 26406) for ‘‘a class of practitioners for which the Medicaid program is the primary source of service revenue.’’ CMS notes that this provision was finalized and published on January 16, 2014 (79FR 2947, 3001) and authorized a state to make payments to third parties on behalf of the individual provider ‘‘for benefits such as health insurance, skills training, and other benefits customary for employees.’’

Congress Urges DOL to Take Up Joint Employment Issue

On August 14, Representative Bradley Byrne (R-AL) and Representative Henry Cuellar (D-TX) sent a letter to Labor Secretary Alexander Acosta asking the Department of Labor to clarify the joint employment standard under the Fair Labor Standards Act through rulemaking. HCAOA is a member of the Coalition to Save Local Businesses, which has spearheaded efforts to address the joint employer issue. The Coalition continues to anticipate an NPRM on joint employer out of the National Labor Relations Board this summer.

Date is Set for Kavanaugh Confirmation Hearing

The Senate Judiciary Committee will hold a three or four-day confirmation hearing for Supreme Court nominee Brett Kavanaugh starting September 4, according to a statement from Chairman Charles E. Grassley last week. That means the marathon hearing will begin the Tuesday after Labor Day.
The Senate panel recently released about 5,700 pages of records on Kavanaugh’s work as a White House lawyer during the George W. Bush administration. These are the first records from the National Archives released as part of the confirmation process.
Majority Leader Mitch McConnell, R-Ky., said he hopes for a committee hearing in early September, followed by a confirmation vote on the floor before October, when the court’s new term begins.
