Don’t Miss Keynote Speaker, Alyssa Dver at the 2018 HCAOA Annual Leadership Conference!

A must-attend event for the home care industry, the 2018 HCAOA Annual Leadership Conference is scheduled to take place in Washington, DC on September 22-25. Alyssa is the expert on The Neuroscience & Social Secrets of Confidence. She’s the co-founder of the American Confidence Institute and author of 6 books, including her latest: “Kickass Confidence: Own Your Brain. Up Your Game.”
 
In her keynotes and workshops, Alyssa entertains, educates and empowers audiences so they can better control their own and other people’s confidence. Clients include IBM, Staples, Pepsi, Royal Bank of Canada, and many more. She also teaches staff and students at MIT, Wharton and other colleges. Prior to ACI, Alyssa built a successful career as a Chief Marketing Officer for seven tech companies and was CEO for an international marketing firm. An innovation junkie, Alyssa has started and sold two of her own companies and is a perpetual Board Advisor to select startups.

This Sunday is Grandparents Day!

Beginning in 1979, the United States has celebrated National Grandparents Day every Sunday after Labor Day. The purpose of the holiday, as stated in the preamble to the statute, is "to honor grandparents, to give grandparents an opportunity to show love for their children's children, and to help children become aware of the strength, information, and guidance older people can offer."
 
Of course, not all recipients of in-home care may be grandparents. However, if it is known that a client has grandchildren, this day is wonderful opportunity to engage with clients and strengthen the client-caregiver relationship. Caregivers may want to encourage clients to share pictures or stories of their grandchildren, should they feel comfortable doing so. If not, something as simple as wishing them a “Happy Grandparents Day!” can be enough to remind them they are appreciated and bring a smile to their faces.

2455 (Kalra): Contact the Governor’s Office Today!

Despite the best efforts of HCAOA, its members at the grassroots level and its lobbyists, we could not prevail upon the California State Senate to defeat AB 2455, the bill by Assembly Member Ash Kalra (D-San Jose). It was approved on a 23-14 vote. AB 2455 awaits further action by the California State Assembly but it is unlikely that the Assembly will defeat the bill.
 
This means the bill will advance to Gov. Jerry Brown's desk for final consideration, which will occur no later than September 30. Gov. Brown vetoed a similar bill, AB 1513 (Kalra), last year on the final day for him to consider it. The only difference between last year's bill is the information allowed to be gathered (name and cell phone) from Home Care Aides who do NOT "opt out" of such information being shared and will apply to newly-registered Home Care Aides and current Home Care Aides when they renew their registration.
 
HCAOA is continuing to fight for the privacy of our caregivers by opposing AB 2455. We can't accomplish this without your help and action. Contact the Governors' office by calling (916) 445-2841 and ask the Governor to veto the bill. Below are some talking points you can use when voicing your opposition.
 
Talking Points:
  • AB 2455 is blatantly inconsistent with Article 1, Section 1 of the California Constitution, which states clearly Californians' rights to "...life and liberty, acquiring, possessing, and protecting property, and pursuing and obtaining safety, happiness and privacy."
  •  There is absolutely no state interest that justifies the disclosure of one's personal information and requires an individual to take an action to "opt out" in order to stay protected.
  • The Department of Finance has noted its opposition to the bill, estimating a $600K cost the for the first year to implement this policy, with subsequent years of $300K ongoing.
  • A California domestic violence organization, Women Escaping a Violent Environment (WEAVE). Opposes the bill, stating: "Requiring the disclosure of any private worker's...telephone number maintained in confidence by the State of California for compliance purposes is a breathtaking invasion of his or her constitutional right to privacy."

Congressional Update

Tax Cut 2.0

 
Congressional lawmakers dealing with tax policy have their eyes on the November midterms as they map out legislation for the rest of the year. The post-election period may be a good time to pass legislation that would retool the Internal Revenue Service, expand retirement provisions, or even make technical corrections to the 2017 tax law (Pub. L. No. 115-97).
 
While the Senate is unlikely to act before election day, Republican leaders in the House will decide soon whether to go ahead. Ways and Means Committee Chairman, Kevin Brady (R-Texas) wants to move on a tax cut 2.0 package in September that would make permanent the individual tax cuts in the 2017 tax law and would include provisions on retirement savings and innovation. Brady said yesterday that the 2.0 package will be marked up in committee the week of September 10.
 
Senate Finance Committee Chairman Orrin G. Hatch (R-Utah) will likely reach out to Democrats in the coming weeks to discuss what type of tax package might get the minority’s support. Hatch has said he wants to move on a package of bills that would overhaul the IRS, while Senate Democrats including Benjamin L. Cardin (D-Md.) want a miscellaneous tax bill before the end of the year.

Trump Issues Executive Order to Promote Retirement Options

 
On August 31, President Donald Trump signed an executive order directing the federal government to make it easier for small businesses to join together to offer employees retirement savings.
 
The order includes a request to open multiple employer plans, or MEPs. MEPs are a type of retirement plan in which small businesses join together to offer saving plans to employees. Opening the plans would mean eliminating or loosening a requirement under current law that the employer participants must have a connection, like branches of the same franchise. Open MEPs are currently a cornerstone of a bipartisan retirement bill in Congress, the Retirement Enhancement and Savings Act. The legislation, introduced by Orrin Hatch (R-Utah) and Ron Wyden (D-Ore.) in the Senate (S. 2526) and Rep. Mike Kelly (R-Pa) in the House (H.R. 5282), initially gained traction when it was introduced but has since stalled in committee.
 
The action will come as the first retirement policy set forward by the administration, which has focused primarily on rolling back President Barack Obama’s retirement policies.

The Judge is on the Hill

On September 4, the Senate Judiciary Committee began hearings for Donald Trump’s second nominee to the high court, Judge Brett Kavanaugh. Day one was off to a rocky start with Democrats calling for a delay in the hearings due to a lack of time to review documents and to secure documents from the White House.
 
Brett Kavanaugh is President Donald Trump’s pick to replace Anthony Kennedy on the Supreme Court. He is a judge on the DC Circuit Court of Appeals, served in both Bush administrations, went to Yale and Yale Law, and clerked for Kennedy. He is 53 years of age.
 
The hearings are projected to continue for the next several days, but he is expected to be confirmed.
